This privacy policy sets out our commitment to protecting the privacy of personal information provided to us, or otherwise collected by us, offline or online, including through our website and is in line with the Privacy Act 1988 (Cth) (“the Privacy Act”). Our Privacy Policy seeks to safeguard the privacy of your personal information in accordance with the Australian Privacy Principles (“the APP’s”) contained within the Privacy Act.

By providing personal information to us, you consent to us collecting, holding, using and disclosing your personal information in accordance with this Privacy Policy. You do not have to provide personal information to us, however, if you do not, it may affect your use of this Site or the services offered on or through it.

CONSEQUENCES OF NOT PROVIDING YOUR PERSONAL INFORMATION  

We use your information to deliver our services. You are not obliged to give us your personal information. However, if you decide not to give us information needed in order to provide you with services, we may not be able to provide those services to you.

We understand how important your privacy us and we also value your trust.  That’s why we do everything we can to protect your personal information and we always try to be transparent and clear on what we do with your data.  This policy explains just that.

When you contact us, visit our website or use our services, we need to collect personal information about you.  This may include:

  • Information about your identity – including your name, contact details (including telephone number, address and email address), date of birth and gender

  • Information about your financial products and types - including your lender details and account details.

  • Information about your location - When you visit our website we may capture your location information, IP address, mobile device and network information and any third-party sites you access

  • Additional Information - in order to complete your claim we may as you to provide us with any other personal information requested by us and/or provided by you or a third party

We may collect these types of personal information directly from you or from third parties.

We collect, hold, use and disclose your personal information so we can:

  • Confirm your identity

  • Assess your application and your claim

  • Manage your claim

  • Contact and communicate with you

  • Improve our service to you and your experience with us

  • Comply with laws, and assist government or law enforcement agencies

 We may also collect, hold, use and disclose your information for other reasons where the law allows or requires us.  From time to time, we may also use your personal information to tell you about products or services we think you might be interested in. To do this, we may contact you by:

4.      Your information and third parties

 We may share your information with third parties for the reasons in section 3 or where the law otherwise allows. These third parties can include:

  • Our employees, contractors and/or related entities

  • Banks / Lenders and or Financial Institutions personal information / customer care departments

  • third parties to collect and process data, such as Google Analytics or other relevant businesses. This may include parties that store data outside of Australia

5.      Keeping your information safe

We store your hard copy and electronic records in secure buildings and systems, or using trusted third parties.

Boomerang uses the Microsoft Office 365 operating system. Portions of your data may be stored through these systems. Microsoft have confirmed that data is stored in part in Australia and also the United States of America.

6.     Cookies and web beacons

We may use cookies on our Site from time to time. Cookies are text files placed in your computer’s browser to store your preferences. Cookies, by themselves, do not tell us your email address or other personally identifiable information. However, they do allow third parties, such as Google and Facebook, to cause our advertisements to appear on your social media and online media feeds as part of our retargeting campaigns. If and when you choose to provide our Site with personal information, this information may be linked to the data stored in the cookie.

We may use web beacons on our Site from time to time. Web beacons (also known as Clear GIFs) are small pieces of code placed on a web page to monitor the visitor’s behaviour and collect data about the visitor’s viewing of a web page. For example, web beacons can be used to count the users who visit a web page or to deliver a cookie to the browser of a visitor viewing that page.

7.      Accessing, updating and correcting your information

You can contact us and ask to view your information at any time. If your information isn’t correct or needs updating, please let us know straight away.

You can ask us for a copy of your information by asking us using our contact form, emailing us at contact@boomerangclaims.com or writing to us at our registered address. There is no fee to ask for your information.

We try our best to make your information available within 30 days after you ask us for it. Before we give you the information, we’ll need to confirm your identity.

8.      Making a privacy complaint

If you are concerned about your privacy, you can make a complaint and we’ll do our best to sort it out.  To make a complaint you can use our contact form or email us directly at contact@boomerangclaims.com. We’ll look into the issue and do our best for you to fix it straight away.

We may, at any time and at our discretion, vary this Privacy Policy by publishing the amended Privacy Policy on our Site. We recommend you check our Site regularly to ensure you are aware of our current Privacy Policy.

Terms and Conditions

1. DEFINITIONS

Advocacy Services": Our efforts to support your Claim for a Refund, including via direct claims, complaint schemes, or participation in relevant class action settlements.

"Applicable Products": Insurance policies or loans potentially mis-sold to you, including hidden fees, undisclosed commissions, or unfair charges.

""Claim": Your authorization for us to seek a Refund on your behalf, including recovery of hidden fees or unfair charges and participation in relevant class action settlements.

"Client Portal": Our digital platform for document and information submission.

"Document Review Services": Our initial assessment to determine the viability of your Claim.

"Fee": A payment of 36% of the Refund, payable upon successful Claim resolution.

"Provider": Financial institutions such as banks and insurance companies.

"Refund": The amount reimbursed to you by a Provider as a result of a successful Claim.

"Settlement Administrator": A third party appointed by a Court or tribunal to administer and distribute financial compensation resulting from class actions.

2. PROCESS OVERVIEW

Account Setup: Agreement acceptance upon Client Portal registration.

Information Submission: Provide required details via the Client Portal for Claim evaluation.

Review and Assessment: We assess your Claim's potential through the provided information.

Advocacy Execution: If viable, we proceed to advocate for your Claim with the Provider or class action Settlement Administrators..

Refund and Fee: Successful Claims lead to a Refund or settlement payment, from which our Fee is deducted.

3. OUR SERVICES

Document Review: Analysis of your information to decide on Claim progression. No fee is charged if we determine the Claim is unlikely to succeed.

Advocacy: ·Representation of your Claim, including referral to AFCA or Settlement Administrators as appropriate. Upon a positive initial review, we will move forward and represent your Claim to the Provider, aiming for a successful Refund. If we believe the Provider makes a fair offer to you, we will accept it on your behalf. If we believe the Provider makes an unfair decision, we will refer the case to AFCA on your behalf at no additional charge.

·Representation in Class Actions: Registering claims within class action settlements, interacting with Settlement Administrators, and handling distributions from such settlements.

Consent to Proceed: In instances where accepting an offer of compensation on your behalf would result in the termination of a live insurance policy then we will seek your consent to proceed, in all other instances where we believe the offer to be fair and reasonable we will accept it.

4. YOUR COMMITMENT

Provide Accurate Information: You must ensure that all information you provide to us related to your Applicable Products is complete and truthful. You must promptly inform us of any changes in your information or circumstances that might affect the Claim.

Exclusive Representation: If you engage our services, it's essential that you do so exclusively for the Claim in question. Should you involve another company for the same Claim, either before, during, or after engaging with us, we reserve the right to charge a fee of up to $99 to cover the initial work conducted on your behalf. This fee compensates for the resources expended in assessing a Claim that cannot be successfully pursued due to prior or concurrent representation.

Refund Processing: Upon securing a Refund, we will contact you to arrange transfer of funds. Unclaimed funds procedures apply.

Unclaimed Funds Procedure: Upon successfully securing a Refund for you, we will attempt to contact you up to 4 times using the email provided at sign up (or an updated email, if you provide us with an updated email address) to arrange the transfer of your Refund. If these attempts don't result in a response, we reserve the right to hold the unclaimed funds in a trust account and make an additional 4 attempts to reach you, incurring a charge of up to $20 per attempt to cover our outreach costs. Should these efforts remain unsuccessful, we reserve the right to retain the funds, with the responsibility then shifting to you to contact us for any claims to the Refund, which may take up to 12 months to issue payment to you. If the Refund remains unclaimed for longer than 1 year, the funds will be permanently forfeited, subject to applicable laws.

5. FEES AND PAYMENTS

No Win, No Fee: You owe us nothing if we do not secure a Refund.

Fee Structure: If a Refund is obtained, you agree to pay us 36% of the Refund amount as our Fee.

Late Payment Fees and Recovery: If payment of our Fee is not received within 14 days from the date of the invoice, we reserve the right to charge interest at 2% per month (or the maximum rate permitted by law) on the overdue amount. You will also be liable for any reasonable costs incurred by us in recovering the outstanding Fee, including but not limited to legal fees, court costs, and collection agency charges.

Cancellation Policy: You may cancel within 10 days without incurring fees. Post-cooling-off period, a cancellation fee may apply, calculated as the greater of $99 or 36% of the potential Refund estimated by us, to cover the work already performed.

6. COMMUNICATIONS

Client Portal: Our primary communication channel for updates and information exchange.

Data Security: We take precautions to protect your information but cannot guarantee absolute security online.

Written Confirmations: For clarity and record-keeping, we may request written confirmation of verbal instructions.

7. PRIVACY AND CONFIDENTIALITY

Data Protection: We adhere to privacy laws and our Privacy Policy in handling your personal information.

Confidentiality: We commit to keeping your information confidential, disclosing it only with your consent or as required by law.

8. DISPUTE RESOLUTION

Feedback: We welcome your feedback and are committed to resolving any complaints in accordance with our internal procedures.

Disputes: Any disputes arising under this Agreement should be communicated to us in writing for resolution. This can be at our registered office or via email at contact@boomerangclaims.com

9. GENERAL TERMS

Governing Law: This Agreement is governed by the laws of New South Wales, Australia.

Entire Agreement: This document constitutes the full agreement between you and Boomerang Claims, superseding any prior discussions.

Amendments: We may, at any time and at our discretion, modify our terms and conditions by publishing the amended terms on our Site.
